Principles for Good Governance and Ethical Practice: A Guide for Charities and
Foundations, released October 2007.
The Panel sets forth 33 principles of sound practice that
should be considered by every charitable organization as a guide for
strengthening its effectiveness and accountability. Six of these principles
describe actions that all charitable organizations must take because they are
required by law. The other 27 describe actions that charitable organizations
should strongly consider following, based on their legal and operational
structure and their particular charitable purposes.

recommendations that charitable organization can take to strengthen transparency
and accountability and an
accountability IQ test to boot. Board and staff should regularly review the
checklist and steps they are taking to accomplish these goals.

Nonprofit Leaders Outscored Their Business Counterparts in a
360-Degree Evaluation - Community Resource Exchange in New York, a nonprofit
social-change consulting firm, in partnership with Performance Programs
Incorporated, a consulting firm that specializes in leadership and
organizational assessment, conducted a research study comparing the results of a
Clark-Wilson Leadership Survey of Leadership Practices between 2002 and 2006.
The 360-degree evaluation of nonprofit leaders and business leaders was based on
feedback from direct reports, managers, peers, and a category called "others."
Nonprofit leaders outscored for-profit leaders in 14 out of the 17 dimensions of
leadership practices queried. These findings are very important for potential
contributors, boards of directors, and the public that often sees the nonprofit
sector as the lesser sector.
Jim Collins, world-renowned author of "Good to Great"
and "Built to Last", has written an analysis about why the findings
came out as they did and its fascinating.

Signs of Stability: Results of the 2007 GuideStar Nonprofit Economic Survey
released December 2007. Trends in contributions and demand for services remain
unchanged pointing to a stability in the steadily expanding nonprofit sector,
despite the uncertainty of the current economic climate. Guidestar invited its
subscribers to complete their annual survey on nonprofits and the economy.
Responses were received by 4,173 individuals representing at least 3,587
nonprofit organizations of varying sizes and missions located in all 50 states
as well as the District of Columbia.

Guidestar Releases 2007 Annual Compensation Report using the data of
102,414 observations from 56,228 Forms 990 filed by 501(c) organizations with
the IRS for fiscal year 2005. Report highlights include: women’s compensation
still lagged behind that of men; median compensation increases for CEO's at
the lower end of the pay scale received nearly a 7% increase, whereas the
higher paid CEO received only a 2% increase; and San Diego ranked 7th of the
20 largest MSAs (Metropolitan Statistical Areas) for the highest median
compensation.

New San Diego Lobbying Law Applies to Nonprofits

On January 1, 2008, a new lobbying disclosure law took
effect for the City of San Diego. The law modifies the existing law by defining
three types of lobbying organizations, two of which must register and report
certain activities and expenditures and a third type of lobbying organization
that must report certain expenditures. This article gives an overview of the

releases 2008-2009 State Budget, 1/10/08 - The budget addresses an

reduction is in conflict with the state constitution or impractical. The budget
also proposes to sell the $3.3 billion of authorized Economic Recovery Bonds (ERB's)

California's Fiscal Outlook: LAO Projections 2007-08 Through 2012-13,
released 11/14/07. At the time the 2007‑08 Budget Act was enacted in August
2007, the budget plan focused on closing the gap between General Fund revenues
and expenditures for the fiscal year and maintaining a $4.1 billion
reserve. Since that time, the 2007‑08 budget situation has deteriorated by
almost $6 billion. Under our forecast, absent corrective action, the state
would end the current fiscal year with a $1.9 billion deficit...

AB 624, adds a section to the corporation code on foundation diversity
reporting. The bill would require every foundation in California with assets of
more than $250 million to gather "diversity data" about the gender, race,
ethnicity and sexual orientation of its members, staff, and board of directors
plus the diversity of grantee organizations as well as contractors you hire. You
would be required to publish that data via your website, if available, and to
include this information in your annual report. Status - approved by the
Assembly on 1/29/08. Note: Sexual orientation of board and employees was removed
from the bill on 2/12/08. Sampling of articles from groups

AB 1983 introduced 2/13/08, is a revised version of AB1192 that was vetoed
by Gov. Schwarzenegger. This bill would establish a mechanism to investigate
reports of abuse, setup a registry to track abusive caregivers, require regional
centers and community care facilities to report evidence of abuse to the State
Dept. of Developmental Services, require providers to check the registry prior
to hiring an employee and prohibits the hiring of registered offenders.

AB 1192, vetoed by the Governor 1/13/08. AB 1192, sponsored by the REACH Project, is a bill that would create a
registry to track abusive caregivers and prevent their hiring. California
currently has registries to protect children and the elderly but there is
nothing to track these offenders who prey on individuals with developmental disabilities. More info about this bill is available at

Streamlining will benefit nonprofits -

SB 618 requires each state
agency, no later than January 1, 2010, to maintain all of its records in an
electronic format. It has the potential to speed up reporting and payments and
to save government and nonprofits millions of dollars annually in paperwork
costs. Presently held in committee & under submission since 5/31/07.

Healthcare Reform - Both Governor Schwarzenegger and the state legislature
are proposing substantial changes to the healthcare system. Without naming each
piece of legislation individually, we will post articles evaluating them here.

ABX11 is rejected by the Senate Committee on Health 1/28/08.
ABX11 would control the policies of the healthcare overhaul; and would cover
70 percent of uninsured Californians and be funded through fees on employers, a
requirement that individuals buy insurance, as well as a hospital and tobacco
tax of $1.75 per pack of cigarettes. Funding would need to be passed separately,
an initiative to be approved by voters on the November ballot.

Would The Governor's Proposed Tax Credit Make Health Care Affordable?
California Budget Project, released 10/22/07. A new CBP Budget Brief analyzes
the Governor's proposed tax credit aimed at helping make health premiums
affordable. The proposal, part of the Governor's health reform plan, would
provide assistance to certain families with incomes up to 350 percent of the
poverty line ($72,275 for a family of four) to purchase health coverage through
a new public purchasing pool.

How much is too much?: A Framework for Evaluating Health Care Affordability,
CBP Budget Brief, May 2007 - "...proposals would require individuals to
purchase or share in the cost of coverage.1 However, these proposals may not
go far enough to make health coverage affordable for California families."

SB 236 Cal CARE program, referred to committee on RLS - a plan to improve access to health care
services for the residents of this state. According to their website, the
Cal CARE
plan is a balanced and realistic approach to improve consumer choice and
introduces better accessibility, while creating greater reliability in
California’s health care system. Furthermore, it proposes to use existing
dollars to care for California’s most vulnerable without raising taxes.

SB 893 failed passage in committee, reconsideration granted. SB 893 amends Section 130105 of the Health and Safety Code, relating
to child development (California Children and Families Program) and reallocates
funds to health care services for children. Funds collected through cigarette
tax monies (Prop 99, Tobacco Tax and Health Protection Act of 1988) and are
appropriated for expenditures by the California Children and Families
Commission, also known as First 5 California would be eliminated. Those
allocations would instead be allocated and appropriated to the commission to
provide health care services to children. Requires a 2/3 vote of the membership
of both houses to pass.

Employment Verification Act of 2007
(AB 689), presently in Assembly
Committee on Revenue & Taxation
- Employers
would be required to verify each new employee's social security number and to
provide annual reports to the Franchise Tax Board showing the name and social
security number of each employee. Violations would result in a fine of $1,000
for each employee, the employer has not provided a valid social security
number. This bill would provide a tax credit of $5 to an employer for each
newly hired employee for whom a valid social security number has been provided
to the Employment Development Dept.

State tax-exempt status (AB 897) takes effect January 1, 2008. Deletes the current requirement that
nonprofits apply for tax exempt status with the state Franchise Tax Board and
provides that an organization is exempt from state taxes if approved by the
Internal Revenue Service pursuant to Section 501(c)(3) of the Internal Revenue
Code for tax exempt status. Nonprofits must file a copy of the IRS notification
with the CA Franchise Tax Board as well as notify them if status is suspended or
revoked.

SB 998 takes effect January 1, 2008 - requires nonprofit public
benefit and mutual benefit corporations to include the mailing address of the
corporation if different from the street address of its principal executive
office address in California on their Statement of Information form filed with
the state.

AB 897, approved by the Governor 9/26/07, provides that an
501(c)(3) organization, as defined, shall be exempt from state taxes, as
provided, upon its submission to the Franchise Tax Board of a copy of the
notification issued by the Internal Revenue Service approving the organization's
tax-exempt status.

Mortgage Reform - Governor Schwarzenegger signs bills on October 5, 2007.
-
SB 223 would prohibit licensed appraisers from being unduly influenced by
someone with an interest in a real estate transaction or from being paid based
on the value of property they evaluate.

SB
385 would make state-regulated mortgage lenders and brokers subject to
federal guidelines on nontraditional mortgages, including notifying consumers of
all risks in a clear, balanced and timely manner.

Healthcare Reform
-
SCHIP Reauthorization Bill has been vetoed by President Bush twice - The House
failed to override 2nd veto on the children’s health insurance bill. The bill
planned to expand the government-sponsored health coverage to include an
additional 4 million low-income children. SCHIP has been extended until March
31, 2009.

OMB Watch Congress to Send Labor/HHS Appropriations to President While SCHIP
Conflict Continues, released 11/6/07. "The Labor/HHS appropriations bill is
likely to be the first piece of appropriations legislation sent to the president
during the Fiscal Year 2008 budget cycle. It will be part of a two-bill package
that also includes funding for the Department of Veterans Affairs. Advocacy
groups are pushing to send the package to the president on Veteran's Day (Nov.
12); in order to meet this deadline, the House may vote as early as today (Nov.
6), with the Senate expected to follow shortly thereafter."

for Healthy Families. "California makes health coverage accessible to
millions of children through the Healthy Families and Medi-Cal Programs using
state and federal funds. Healthy Families currently provides low-cost health
coverage to over 775,000 children, thereby reducing the number of children who
would otherwise be uninsured. The federal funding that supports Healthy Families

Robocall Privacy Act of 2008, introduced 2/12/08 by Senator Dianen Feinstein.
The bill would place restrictions on how and when prerecorded messages, known
as robocalls, can be made 30 days before a primary and 60 days before a
general election. The bill would only affect prerecorded calls, not calls made
by volunteers at phone banks.

Estate Tax
Revision Legislation - On November 14, 2007, the Senate Finance Committee held
a hearing on estate tax laws with guest witness Warren Buffet who stated the
tax repeal would only benefit the richest of Americans and not improve the
well-being of the lower-income worker.

H.R. 4235 - To amend the Internal Revenue Code of 1986 to restore the
estate tax, to repeal the carryover basis rule, to reduce estate tax rates
by 20 percent, to increase the unified credit against estate and gift taxes
to the equivalent of a $3,000,000 exclusion and to provide an inflation
adjustment of such amount, and for other purposes. Introduced on 11/15/07
and referred to the House Committee on Ways and Means.

H.R. 4172 - To amend the Internal Revenue Code of 1986 and the Economic
Growth and Tax Relief Reconciliation Act of 2001 to restore the estate tax
and repeal the carryover basis rule and to increase the estate tax unified
credit to an exclusion equivalent of $3,500,000. Introduced on 11/14/07 and
referred to the House Ways and Means Committee.

H.R. 4242 - amends the Internal Revenue Code of 1986 to retain the
estate tax with an immediate increase in the exemption, to repeal the new
carryover basis rules in order to prevent tax increases and the imposition
of compliance burdens on many more estates than would benefit from repeal,

Means Committee.

Temporary Tax Relief Act of 2007 (H.R. 3996)
passes without the IRA Charitable Rollover portion of the bill and signed into
law by President Bush on 12/26/07. Amends Internal Revenue Code
provisions relating to the alternative minimum tax (AMT), the discharge of mortgage
indebtedness, and tax administration and extends certain expiring tax credits,
deductions, and other tax incentives including the IRA
Charitable Rollover provision that provides persons aged 70½ and older with
the opportunity to contribute to charity out of their IRAs without suffering
adverse tax consequences for another year. Introduced 10/30/07;House
passes H.R. 3996 on 11/9/07, signed into law on 12/26/07.

H.R.3970 - To amend the Internal Revenue Code of 1986 to provide additional
tax relief to low and moderate income individuals, to repeal the individual
alternative minimum tax (AMT), to reform the corporate income tax, and for other
purposes. Referred to House Committee on Ways and Means, 10/25/07.

Watch, AMT: Mother of All Tax Bills & Progeny, released 11/6/07. The "plan's central feature is the permanent repeal the AMT at a ten-year cost of
$845 billion. It should be noted this estimate assumes current law — namely the
Bush tax cuts — expires. If those tax cuts were extended, AMT repeal cost would
nearly double to about $1.5 trillion over ten years."

The Public Good IRA Rollover Act of 2007 (H.R.
1419 and S.
819) was introduced in Congress to extend the current IRA Rollover which is
scheduled to expire 12/31/07, by making it permanent. It would remove the
current $100,000 annual limit on donations, make all charities eligible to
receive donations, and provide IRA owners with a planned giving option starting
at age 59½. instead of 70½; for more information. Referred to House Ways and
Means Committee, 3/8/07 and its counterpart was referred to Senate Finance
Committee on 3/8/07.

H.R. 4090, sponsored by Rep. Bob Filner (CA) - amends the Internal Revenue
Code of 1986 to exempt motor vehicle donations to certain charities from the
limitations on such donations if the charity services and manages the daily
operations of their donation program in-house. Introduced 11/6/07 and referred
to House Ways and Means Committee.

The College Cost Reduction Act of 2007 (H.R. 2669) was signed into Law on
9/27/07. The bill provides for three major actions: increasing the maximum Pell
grant award; capping the loan repayment terms at 15% of discretionary income;
and creating a debt-forgiveness program for public-sector employees, including
those working for nonprofit organizations. Amendments made by this law became
effective on October 1, 2007. Interest rate cut savings per California
student over the life of the loan at 4-year school (once fully phased in) will
be $4,830.

College Cost Reduction and Access Act Technical Amendments of 2007 (HR 4153)
makes certain technical corrections and transition amendments to the College
Cost Reduction and Access Act. Adds special rule for married borrowers
filing separately- 'In the case of a married borrower who files a separate
Federal income tax return, the Secretary shall calculate the amount of the
borrower's income-based repayment under this section solely on the basis of
the borrower's student loan debt and adjusted gross income.' Referred to
Senate committee on Health, Education, Labor, and Pensions, 11/14/2007.

Volunteer Mileage Reimbursement Increase Proposed, S. 403,
introduced by Senator Feingold (D-WI) and referred to Finance Committee on 1/26/07
- would raise the mileage
reimbursement rate for volunteers who use their vehicles for charitable purposes
from 14 cents to 40.5 cents per mile. The proposal would make the volunteer rate
equal to that of businesses.

H.J.RES.20 Revised Continuing Appropriations Resolution, 2007 - passes House
286-140 on 1/31/07 & passes the Senate 81-15 on 2/14/07 - Signed by President
and became Public Law No: 110-005 on 2/15/07. A $463.5 billion joint resolution,
making further continuing appropriations for the fiscal year 2007, increases
spending or maintains service levels in health, education and housing programs.
The resolution also makes $10 billion in cuts to 60 programs and purges earmark
language from bills that were drafted but not passed during the 109th Congress.

S. 1, Honest Leadership and Open Government Act of 2007(enacted, short title)
otherwise known as
Legislative Transparency and Accountability Act of 2007 (previous title
approved in the Senate) - On 7/31/07, The House passed the bill and the Honest
Leadership and Open Government Act of 2007 was signed into law on 9/14/07.
According to the legislation, lawmakers must disclose earmarks and provide 48
hours advanced notice of such provisions via the internet.

regulations.

Nonprofits may run issue ads during election periods that mention federal
candidates under certain conditions including urging a candidate to take a
particular position or action with respect to an issue under new rule by the FEC.

FEC Resolved Two Matters Involving Internet Activity; Applies Media Exemption to
Political Blogs FEC has unanimously resolved two complaints
alleging that Internet blog activity is subject to Commission regulation,
finding that the activity is exempt from regulation under the media or volunteer
exemption. In Matter Under Review (MUR) 5928, the Commission determined that Kos
Media, L.L.C., which operates the website DailyKos, did not violate the Federal
Election Campaign Act.

FEC to Notice Draft Rule Allowing Issue Advocacy Broadcast in August to
incorporate the June decision by the Supreme Court which found the federal
electioneering communications ban unconstitutional when applied to issue ads
with the intention that the rule take effect in Mid-December 2007. The
Court determined that Wisconsin Right to Life Inc. was entitled to an
exemption from restrictions on broadcast advertising contained in the Bipartisan
Campaign Reform Act of 2002.

Don't Throw Away Your
Tax-Exempt Status -
Beginning in 2008, small
tax-exempt organizations will have a new filing requirement.
It’s short, easy and electronic – it's the new e-Postcard.
If you are a tax-exempt
organization that normally has annual gross receipts of
$25,000 or less and does not have to file Form 990 or
990-EZ, you must file the e-Postcard. The e-Postcard is due
by the 15th
day of the fifth month after the close of
your organization's tax year. So if your organization operates on a
calendar year, the e-Postcard is due by May 15 of the
following year.
What happens if you don't
file? You risk losing your tax-exempt status!

Final Release of Redesigned Form 990 for FY2008 - The new form incorporates
comments and suggestions from the over 650 e-mails and letters received during
the comment period, which closed on September 14, 2007. It retains the
redesigned draft’s format of a core form and a series of schedules. In response
to public comments, the new core form allows an organization to describe its
exempt accomplishments and mission up-front and provides more opportunities
throughout the form for the organization to explain its activities. Other major
changes were made to the form’s summary page, governance section, and various
schedules, including those relating to executive compensation, related
organizations, foreign activities, hospitals, non-cash contributions and tax
exempt bonds.

and Confusion: The Impact of Ambiguous IRS Regulation of Political Activities by
Charities and the Potential for Change; OMB Watch Report released November
2007. The report summarizes the pros and cons of creating a bright-line rule
defining what is and is not prohibited partisan intervention in elections by
charities and religious organizations as discussed by a panel of legal experts
on August 3, 2007. Is the time ripe for clearer IRS rules on
nonpartisan voter engagement while reducing nonprofit risk?

IRS has proposed new rules that would make group exemption letters and decisions
to deny or revoke tax-exempt status publicly available. The IRS is accepting
public comments on these disclosure rules through November 13, 2007. Send

Revenue Ruling 2007-41, Political Campaign Activities of Exempt Organizations
provides guidelines with specific examples on the scope of the tax law
prohibition of campaign activities by section 501(c)(3) tax-exempt
organizations. The ruling shares 21 factual situations involving 501(c)(3)
organizations, including churches, and activities that may be prohibited
campaign intervention. The ruling applies tax law and regulations and concludes
whether prohibited political activity has or has not occurred. Released

Centre City Development Corporation (CCDC) launches Health and Human Services
Capital Funding Assistance Program - CCDC is
soliciting applications for this new program which provides low-interest service
repayment loans to qualified nonprofit organizations, up to $1,000,000 per
project on a matching-fund basis, to assist with facility relocation and
rehabilitation or expansion through building rehabilitation proposals. A total
of $3,000,000 is available for the first round of program funding. The agency
facilities must have been in operation at downtown locations for a minimum of
five years and at least 50 percent of a facility’s clients must be persons who
work and/or live downtown. A Pre-Application Conference will be held on 2/12/08
at 10:00am.

City of San Diego Community Development Block Grant Applications
The city expects to receive approx. $15 million
in CDBG funds for Fiscal Year 2009, beginning July 1, 2008. Approximately $9
million will be available for distribution by the City Council. Application

MetLife Foundation and the Local Initiatives Support Corporation (LISC)
Community Safety Initiative are now accepting applications for the 2008
MetLife Foundation Community-Police Partnership Awards. These awards provide
$10,000 to $25,000 grants to organizations that demonstrate innovative
partnerships between community groups and police to promote neighborhood safety
and revitalization efforts. Deadline for preliminary application, 2/29/08

NOFA for Nonprofit Organizations to Operate Transitional Housing for the
Homeless (families and individuals), San Diego Housing Commission.
Approximately $1,000,000 is available through the Housing Trust Fund's
Transitional Housing Program for an initial term of one year (July 1, 2008 -
June 30, 2009) with two additional one-year renewal options contingent upon
future funding availability and program performance. Proposals are being
accepted through March 3, 2008.

Margaret Higgins, Psy.D., has been named Clinical
Director at Survivors of Torture, International.

Second Chance
was awarded $681,500 in federal funds for its Prisoner
Re-Entry Program (PREP). Second Chance plans to devote the earmark funds, along
with City of San Diego CDBG funds, toward building a second classroom and for
the employment of additional staff to significantly expand its services.

Alliance Healthcare Foundation recently awarded grants
to SANDAN members Casa de Amparo and Vista Hill. Vista Hill Foundation
received a $100,000 2-year grant to to launch an alcohol and drug Intensive
Outpatient Program (IOP) in the evening hours at the ParentCare Center.

Congratulations to SANDAN Members United Way of San Diego
County and Volunteer San Diego for being nominated for the San
Diego Business Journal's 2008 Best Places to Work Awards.

SANDAN welcomes Rick Wanne, the new County of San
Diego Director of Health & Human Services Agency Contract Support (ACS)
replacing Diana Francis who retired in November. Rick joins ACS following tenure

Announcement from Walter Philips, Chair, SANDAN Board of Directors
It is with sadness that I am announcing that Jeanine Politte has
decided to move on from SANDAN to pursue other opportunities, including advanced
training in non-profit management. Her last day with SANDAN will be March 15,
2008. SANDAN will sorely miss her expertise, historical perspective and
professionalism over the past six years. We know that you join us in thanking
her for the work she did with SANDAN and wishing her well in her new endeavors.

Board of Directors renew terms and elect new board member and officers for FY
2007-08. SANDAN's Board of Directors elect a new board member, renew
terms and elect officers for FY 2007-08 at the June 1st annual meeting. We want
to share a warm welcome to Tom Scott, Executive Director of the San Diego
Housing Federation, as he joins the board as our newest director. Tom brings a
new viewpoint to the board representing the nonprofit housing community. We also
want to thank SANDAN's Board for continuing to shape and transition the
organization into the "Go-To" association for all nonprofits.
